TERMS AND CONDITIONS OF THE HRLOVE PORTAL
I. GENERAL PROVISIONS
1. These Regulations and the provisions of the law in force on the territory of the Republic of Poland, in an exclusive manner, determine the terms and conditions of the provision by the owner of the hrlove.pl website; Bayrone Sp. z o.o. NIP: 222 09 19 120 e-mail: kontakt@bayrone.com (hereinafter: “Administrator”)
2. The administrator of personal data processed in connection with the use of services offered through the HR LOVE website, is Bayrone Sp. z o.o. NIP: 222 09 19 120 e-mail: kontakt@bayrone.com
3. The name of HRLOVE Portal and its Internet address, its concept, graphic design, software and database are legally protected – in accordance with the provisions of Polish law.
4. These Regulations set out the rules for the use of the HRLOVE Portal available at: hrlove.pl and is the Terms and Conditions referred to in Article 8 of the Act on Provision of Electronic Services.
5. These Terms and Conditions set forth, in particular:
a) rules for registration and use of an account within the HRLOVE Portal;
b) terms and conditions for placing Electronic Orders within the HRLOVE Portal;
c) the rules for entering into Sales Agreements using the services provided within the HRLOVE Portal.
6. The use of the HRLOVE Portal is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
- internet access
- web browser
7. In accordance with applicable laws, the Administrator reserves the right to limit the provision of services through the HRLOVE Portal to persons who are 18 years of age or older. In such a case, potential Customers will be notified of the above.
8. Customers may access these Terms and Conditions at any time through the link provided on the home page of https://hrlove.pl/regulamin and save their content and make a printout.
II. DEFINITIONS
The terms used in the Regulations shall mean:
1. Client – a natural person, legal entity or organizational unit that is not a legal entity, to which special regulations grant legal capacity, who makes an Order on the HRLOVE Portal;
2. Consumer – a Customer who is a natural person and makes an Order within the HRLOVE Portal, and thereby enters into a contract.:
a) not directly related to its business or professional activity (consumer within the meaning of Article 221 of the Civil Code, i.e. a natural person making a legal transaction with an entrepreneur not directly related to its business or professional activity).
b) directly related to its business activity, when it is clear from the content of this contract that it does not have a professional character for it, arising in particular from the subject of its business activity, resulting from the extract made available on the basis of the provisions on the Central Register and Information on Business Activity,
3. Civil Code – the law of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).;
4. Regulations – these Regulations for the provision of electronic services on the HRLOVE Portal https://hrlove.pl/regulamin
5. HRLOVE portal – Internet service available at https://hrlove.pl through which the Customer may, in particular, place Orders;
6. Account – a place on the website defined in these Regulations as the HRLOVE Portal, available after registration and logging in, through which the Customer may view, edit and correct his/her personal data processed by the Administrator, as well as use the services offered through the HRLOVE Portal.
7. Login – the private and real name of the Customer assumed by the Customer at the stage of Account registration. The Login has an individual and singular character, which excludes the possibility of registration of two Customers using the same Login;
8. Password – a sequence of letters, numbers and special characters containing at least 6 positions, set individually by the Customer when registering on the HRLOVE Portal and enabling the Customer to use the services offered by the HRLOVE Portal, including, in particular, allowing access to the Account;
9. Goods – products presented on the HRLOVE Portal;
10. Sales agreement – an agreement for the sale of Goods within the meaning of the Civil Code, concluded between the Administrator and the Customer, concluded using the Internet service of the HRLOVE Portal;
11. Consumer Rights Act – the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827).;
12. Act on Providing Services by Electronic Means – Act of July 18, 2002 on Providing Services by Electronic Means (Journal of Laws. No. 144, item 1204 as amended.);
13. Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods .
III. HRLOVE PORTAL REGISTRATION AND ACCOUNT CREATION
1. Each Customer – before completing the registration procedure on the HRLOVE Portal and creating an Account – is obliged to read the Terms and Conditions.
2. The current content of the Terms and Conditions is permanently available on the HRLOVE Portal website under the Terms and Conditions tab If the content of the Terms and Conditions is changed, the condition for the continued use of the service defined in these Terms and Conditions as the HRLOVE Portal is the Client’s acceptance of the new version of the Terms and Conditions, which the Client will be asked to do at the next login to the HRLOVE Portal.
3. The condition for the creation of an Account by the Customer and his/her use of the services offered through the HRLOVE Portal is the acceptance of the Regulations and consent to the processing of the Customer’s personal data by the Administrator.
4. Each customer is obliged to comply with the provisions of the Regulations.
5. Agreeing to receive commercial or marketing information sent by the Administrator to the e-mail address indicated by the Client during the registration procedure on the HRLOVE Portal is voluntary and is not a condition for creating an Account.
6. In order to create an Account, the Customer must complete the registration form provided on the website at: https://hrlove.pl/account
7. Successful completion of the registration procedure on the HRLOVE Portal is confirmed by the Administrator via email by sending an activation link, the use of which then allows you to log in to the site and start using the HRLOVE Portal. Logging in involves entering in the appropriate fields the Login provided during the registration procedure and the unique Password established by it.
IV. RULES OF USE OF THE HRLOVE PORTAL.
1. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the HRLOVE Portal takes technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted over the Internet.
2. The customer is obliged to:
a) not to provide or transmit content prohibited by law, e.g. content that promotes violence, defamatory or infringes personal rights and other rights of third parties, b) to use the HRLOVE Portal in a manner that does not interfere with its functioning, in particular through the use of specific software or devices, c) to use the HRLOVE Portal in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of Internet use.
V. PROCEDURE FOR PLACING AND PROCESSING AN ORDER.
1. Information about Goods provided on the websites of the HRLOVE Portal, constitute an invitation to conclude an agreement, within the meaning of Article 71 of the Civil Code.
2. In order to make an order through the HRLOVE Portal, one must go to the website https://hrlove.pl, make a selection of goods, taking further technical steps based on the messages displayed to the customer and the information available on the website.
3. During the process of placing the Order – until clicking on the button “Order with obligation to pay”. – The Customer has the possibility to modify the entered data and the selected Goods. To do so, follow the messages displayed to the Customer and the information available on the site.
4. After the customer using the HRLOVE Portal has entered all the necessary data, a summary of the placed order will be displayed.
5. In order to send an Order, it is necessary to provide personal data marked as mandatory and press the “Order with obligation to pay” button.
6. The Customer’s sending of the Order constitutes a statement of intent to conclude a Sales Agreement with the Administrator, in accordance with the content of the Regulations.
7. Once the Order has been placed, the Customer will receive an email titled “Confirmation of Order Placement on the HRLOVE Portal, containing the final confirmation of all material elements of the Order.
8. Order processing begins when the customer makes payment for the ordered goods.
9. The contract is concluded in the Polish language.
VI. PRICES AND PAYMENT METHODS.
1. Prices of Goods are given in Polish zloty and include all components, including VAT.
2. The customer has the option of paying the price:
a) 19,99 zł translation
b) 150,00 zł consultation (1h )
VII. WITHDRAWAL.
1. A Customer who is a Consumer, who has entered into a remote sales contract through the HRLOVE Portal, may withdraw from the contract without giving reasons by making a statement to that effect in writing within 14 days. The period within which the Consumer may withdraw from the contract is counted from the date of receipt of the goods by the Consumer. To meet this deadline it is sufficient to send a statement of withdrawal before its expiration to the address of the Administrator’s headquarters.
2. Nevertheless, where the contract concluded with the Administrator concerns the provision of digital content not delivered on a tangible medium, for which the consumer is obliged to pay the price, the right of withdrawal is not available. The Administrator shall commence performance with the express and prior consent of the Consumer, who is hereby informed (prior to the commencement of performance) that after the Administrator’s performance he will lose his right to withdraw from the contract and acknowledges this. The Administrator shall provide the Consumer with a document confirming the conclusion of the contract.
VIII. COMPLAINTS ABOUT GOODS.
1. The Administrator is liable only to the Customer who is a Consumer under the warranty for defects to the extent specified in the Civil Code.
2. Complaints can be made electronically to the Administrator’s email address or by any other legally permissible means.
3. The administrator has the right to negatively consider the complaint.
4. Within 14 working days of receipt by the Administrator of the advertised goods, the complaint will be considered, and an employee of the Administrator will inform the Customer of the result of the complaint procedure via e-mail, to the e-mail address provided when registering the Account.
5. Negative processing of a complaint does not deprive the Consumer of the right to pursue his claims through civil action.
IX. ADMINISTRATOR’S RESPONSIBILITIES.
1. HRLOVE Portal shall take measures to ensure the fully correct operation of the service and the HRLOVE Portal websites, to the extent of current technical knowledge, and undertakes to remove within a reasonable time any technical irregularities reported by Customers.
2. Irregularities related to the functioning of the service and the websites of the HRLOVE Portal, the Customer may report by e-mail to the e-mail address: serwiś@bayrone.pl
In the complaint, the Customer should describe the type and date of the irregularity related to the functioning of the HRLOVE Portal.
4. The Administrator reserves the right to make technical interruptions in the functioning of the Internet service defined in the Regulations as the HRLOVE Portal, resulting in particular from making changes or updates to the system recommended by the Administrator Customers will be notified of technical interruptions and their duration through the customary announcement.
5. The actions or omissions of entities responsible for intermediating payments or authorizing payments made by credit cards or other electronic payment instruments with which the Customer makes payments on the HRLOVE Portal shall be the responsibility of such entities.
6. The Customer undertakes to carry out purchases by electronic means in accordance with the laws in force in Poland and the provisions of these Regulations.
7. The Administrator’s liability under warranty – within the limits arising from the provisions of the Civil Code – in relations with non-consumers is excluded.
8. Any provisions of the above rules and regulations that are prohibited under applicable law in relations with Consumers should be interpreted in such a way that they are binding only in relations between the Seller and entities that are not Consumers.
X. DISPUTE RESOLUTION AND FINAL PROVISIONS
1. The customer, who is a Consumer, may, if interested, use out-of-court ways of dealing with complaints and claims. Disputes regarding online shopping can be resolved through mediation proceedings before the Provincial Inspectorates of Trade Inspection or a trial before an arbitration court at the Provincial Inspectorate of Trade Inspection. Consumers can also use other methods of out-of-court dispute resolution and, for example, submit their complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
2. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on rendering electronic services and other relevant provisions of Polish law shall apply.
